Following the advice of the Minister of Labour and Employment, Sen. Chris Ngige, to the Federal Ministry of Health (FMoH) on the need to commence ‘No Work No Pay’ rule against the striking Nigerian Association of Resident Doctors (NARD), the later has directed all Chief Medical Directors and Medical Directors in Federal Tertiary Hospital to compute the financial implication of the policy from Monday 2nd August, 2021 against the doctors,
According to a letter by FMoH Director, Department of Hospital Services, Dr. Adebimpe Adebiyi, directing CMDs and MDs to kickstart the principle, Minister of Labour and Employment earlier communicated to the Health Minister through a letter, to immediately commence the action.
The FMoH directive letter in full sstated: “RE: RE: LAW AND PRINCIPLES CONCERNING THE RIGHT TO STRIKE.
APPLICATION OF SECTION 43(1) [A] OF THE TRADE DlSPUTE ACT CAP. T8, LAW S OF THE FEDERATION OF NIGERIA (LFN) 2004 (“N0 WORK NO PAY”).
“The Ministry is in receipt of a letter from the Honourable Minister, Federal Ministry of Labour and Employment (FMoL&E), informing the Ministry of the laws Governing the ongoing strike by the Nigerian Association of Resident Doctors [NARD] and the need to immediately apply the provisions of Section 43(i) (a) of the Trade Disputes Act on “Special provision with respect to payment of wages during strikes and lock-outs” known in labour parlance as “‘No Work, No-Pay” with effect from Monday 2nd August 2021 when the strike was commenced by NARD members.
“Consequent on the above, I am directed to inform you to commence the implementation of “No Work, No Pay’ policy on striking Doctors w.c.f Monday 2nd August 2021 including other Health workers that may embark on strike subsequently.
“This directive is In line mlh the provisions of Section 43 (l) (a) of the Trade Dispute Act which inter-alia states ” …… where any worker takes part In a strike, he shall not be entuled to any wages or renumeranon for the period of the strike, and any such period shall not account for the pumose of reckoning the penod of continuous employment and all right dependent on contmuzty of employment shall be prejudiu’ally affected accordingly …..”
“You are to compute the financial implication of the “No Work, No Pay” from the salaries of the Resident Doctors and any other Health worker that participated in strike using the attached Template and forward same to the IPPIS Office through the Federal Ministry of Health (FMoH)for Implementation w.e.f. 2nd August, 2021.
